Publication: Parallel Import in Nigeria: The Federal Competition and Consumer Protection (FCCPA) Regime

Intellectual Property (“IP”) protection essentially aims to reward inventors, creators, and producers for their hard work and investments. Yet, we must also ensure healthy competition and public access, avoiding monopolies, especially in global trade. In the bid to strike this balance, principles like parallel importation and the doctrine of exhaustion have emerged.

In this paper, our Partner, Similoluwa Oyelude, and Associate, Chioma Egboh-Nwachukwu, explore the legality of parallel imports as a competition mechanism vis-à-vis IP rights in Nigeria, drawing insights from international, regional, and national frameworks. In this paper, we delve into the anti-restrictive impact of the FCCPA on IP rights owners in Nigeria.
