On June 9, 2023, the Nigerian President signed into law the Electricity Act, 2023, which repealed and replaced the Electric Power Sector Reform Act, 2005 as the primary federal statute on matters relating to the Nigerian Electricity Supply Industry. This legislative development was preceded by a constitutional amendment that permitted Nigerian States to legislate in respect of areas covered by the national grid.
 
In this paper, we highlight ten key innovative provisions in the Electricity Act, 2023.
