Athanasius has advised on the tax implications of some innovative and record-breaking transactions in the Nigerian corporate and commercial law space. Athanasius is representing leading companies in tax litigations at the Tax Appeal Tribunal and in different superior courts in Nigeria. Athanasius is an essential team member in many important cases of the firm:

  • Representing a leading oil and gas company in court on separate tax claims by a state tax authority exceeding USD160 million (circa NGN60 billion) regarding alleged shortfall in Pay As You Earn Tax and other tax remittances.
  • Representing a leading employers’ association and leading manufacturers of consumer products in Nigeria on (i) the proper interpretation of the Sugar Tax introduced by the Finance Act 2021, and (ii) the power of the Minister of Finance, Budget and National Planning to alter the excise duty rates through a circular.
  • Representing a foreign satellite communications company in an appeal at the Federal High Court, Nigeria on the tax implications of its service contract with an agency of the government.
  • Advising a leading power transmission company in two London-seated ICC arbitrations involving a claim of over USD900mm against the Federal Government of Nigeria in respect of a USD6bn hydro-power project in North-East Nigeria.
